The end of the asylum process after a negative decision
When:
- The legal process appears to be at an end
- There is no prospect of new evidence
- Section 4 support is not available
- ASSIST support is not available because legal processes have been exhausted
the SWVG volunteer may request MAG to approve an assessment of the situation and options available from Jo Renshaw, SWVG Legal Advisor.
The options open to someone in this situation
Voluntary Return
If someone is denied the option of appeal, or does not wish to appeal, then Voluntary Return might be the most suitable way to leave the United Kingdom (see pp 65 – 78 of MH Guide to Asylum Process https://www.migranthelpuk.org/Handlers/Download.ashx?IDMF=022acee2-fa23-4cef-a691-983050a7ada2).

Return to another country
If no further claim for asylum can be pursued in the UK, the volunteer should discuss this option (see pp 65 – 78 of MH Guide to Asylum Process https://www.migranthelpuk.org/Handlers/Download.ashx?IDMF=022acee2-fa23-4cef-a691-983050a7ada2)
Staying in the UK without Leave to Remain
If someone wants to stay in the UK without permission, the volunteer should point out the consequences of this choice.
- The possibility of being picked up, detained and forcefully removed
- Restricted access to health care
- Life threatened by destitution and homelessness
Temporary support
While the person decides what to do, the SWVG volunteer can:
- Support them in discussing his options with friends and relatives and in securing accommodation with them.
- Support them in being active and maintaining their health.
